According to the BBC, just minutes after the International Court of Justice (ICJ) ordered the suspension of the offensive in Rafah, Israeli forces deliberately carried out a series of attacks on the Shaboura refugee camp in the center of the Palestinian city.

The ICJ ruling on the suspension of the Rafah offensive is an important milestone and comes at a critical time, with growing global concern about the humanitarian conditions in the Gaza Strip and the escalation of violence that has severely affected the civilian population.

Having signed the Convention on the Prevention and Punishment of the Crime of Genocide, Israel finds itself obligated to protect human rights in contexts of armed conflict. However, the implementation and acceptance of these obligations are often complex, as evidenced by Israel's immediate response to the ICJ ruling.

The ICJ is the UN's principal judicial body, created to resolve disputes between states and ensure compliance with international law. Operating since 1946, it is composed of 15 judges, and its decisions are legally binding. However, the court lacks the means to ensure compliance.

 

The Order of the ICJ

"Israel must immediately suspend the military offensive, as well as any other action in Rafah that could inflict on the Palestinians in Gaza living conditions likely to lead to their total or partial physical destruction.".

The court based its decision on Israel's obligations under the Convention on the Prevention and Punishment of the Crime of Genocide, considering the worsening living conditions of civilians in Rafah. Furthermore, the ICJ ruled that Israel must keep the Rafah crossing open to allow humanitarian aid into Gaza.no restrictions".

Israel must also “take effective measures to ensure unhindered access to the Gaza Strip for any commission of inquiry, fact-finding mission or other investigative body“UN mandated”to investigate allegations of genocide".

Furthermore, Israel must submit a report to the ICJ within 90 days on the measures adopted in accordance with the decision.

 

The Decision


The decision was approved with 13 votes in favor and two against, according to the president of the ICJ, Lebanese Nawaf Salam. This measure is the result of a petition from South Africa filed in December, two months after the start of the conflict between Israel and the Palestinian group Hamas.

In January, the ICJ had already ordered Israel to refrain from any act of genocide and to allow humanitarian aid into the Gaza Strip.

He also called for the immediate release of the hostages captured by Hamas during the October 7, 2023 attack on Israel, expressing deep concern at the continued captivity of many of these hostages and reiterating the call for their immediate and unconditional release.

In light of the worsening situation in Rafah, South Africa has requested new measures from the ICJ, which were announced today at the court's headquarters in the Netherlands, ordering Israel to take "all necessary and effective measures" to ensure the unhindered provision of basic services and humanitarian assistance, including food, water, fuel, and medical supplies.

Israel must also ensure that its armed forces do not commit acts that violate the rights of Palestinians in Gaza under the Convention on the Prevention and Punishment of the Crime of Genocide, including preventing the delivery of humanitarian aid.

 

Reactions to the ICJ Decision

The Israeli prime minister stated that a ceasefire would allow Hamas fighters to regroup and would jeopardize the release of hostages still held captive. He also asked the court not to issue new orders, arguing that his military campaign is solely for self-defense.

The European Commission also reaffirmed that the ICJ rulings on the suspension of the Israeli military incursion into Rafah “are binding” and all parties must comply.

"I take note of the ICJ's decision to order the suspension of military operations in Rafah and the opening of a corridor for access to humanitarian support and basic services.".

Commissioner for Crisis Management Janez Lenarcic wrote on the social network X (formerly Twitter).

Sources in Brussels, cited by AFP on condition of anonymity, indicated that the European Union would be willing to control the humanitarian aid crossing that the ICJ ordered to be re-established.

 

Context of the Conflict


On October 7, 2023, Hamas militants killed approximately 1.200 Israelis and captured approximately two hundred hostages.

The Hamas attack triggered an Israeli offensive on the Gaza Strip that, according to the enclave's authorities, has already resulted in more than 35.800 deaths. Hamas, considered a terrorist organization by Israel, has controlled the Gaza Strip since 2007.

Half of the hostages have already been released, mainly through exchanges of Palestinian prisoners held by Israel during a week-long ceasefire in November last year. Israel claims that about 30 hostages remain in Gaza, along with the bodies of approximately XNUMX hostages.

The Israeli army recently announced the recovery of the bodies of three hostages killed after they were allegedly taken to Gaza by the attackers. This announcement comes less than a week after the discovery of the bodies of three other Israeli hostages killed during the Hamas attack.
