South Africa Accuses Israel of Genocide.
South Africa has formally accused Israel of genocide in the Palestinian enclave of Gaza, filing a lawsuit with the International Court of Justice (ICJ), the principal judicial organ of the UN , in The Hague.
The Pretoria government released a statement saying the request was made based on alleged violations by Israel of its obligations under the convention on the prevention and punishment of the crime of genocide in relation to Palestinians in Gaza.
The Announcement
South Africa's Ministry of Foreign Affairs (DIRCO) noted that the court had been approached for an order requiring Israel, as a member state, to refrain from any acts that could constitute genocide or related crimes, in accordance with the genocide convention. .
“The executive ordered that the ICJ in The Hague be approached for an order ordering Israel, which is also a member state, to refrain from any acts that could constitute genocide or related crimes under the convention.”
The South African Ministry of Foreign Affairs (DIRCO) highlighted in the statement.
South Africa, as a signatory to the convention, stated that it was obliged to prevent genocide and expressed serious concern about the situation of civilians in Gaza due to the indiscriminate use of force and the forced removal of inhabitants. The South African government has declared its condemnation of all violence and attacks against civilians, including Israelis.
The statement clarifies that a request to this effect was presented to the court on December 29, 2023, requesting an urgent declaration that Israel is violating its obligations under the genocide convention. South Africa demands that Israel immediately cease all actions in violation of these obligations and take related measures.
The South African Ministry of Foreign Affairs expressed in a statement that it was;
“extremely concerned about the situation of civilians involved in the Israeli attacks on the Gaza Strip due to the indiscriminate use of force and forced removal of inhabitants.”
The ICJ in The Hague accepted the charge, considering that it would involve direct violations of obligations established by the 1948 genocide convention, to which both nations are signatories. The convention provides punishments for acts and incitement to mass murder.
War Crimes
Reports point to war crimes and crimes against humanity, in addition to direct violations of the convention signed by both nations in 1948.
According to the associate director of international justice at Human Rights Watch, Balkees Jarrah, this could be the opportunity for the ICJ to observe Israel's actions in Gaza in light of the 1948 Genocide Convention.
It should be noted that the international criminal court (ICC) is responsible for prosecuting individuals for war crimes, crimes against humanity and genocide, while the ICJ mediates disputes between nations.
In a statement, the ICJ explained that the applicant [Republic of South Africa] further claims that “ Israel, since 7 October 2023 in particular, has failed to prevent genocide and has failed to prosecute direct and public incitement to genocide ” and that “ Israel has engaged, is engaged and risks further engaging in genocidal acts ” against the Palestinian people in Gaza.
Israel's Contest
Israel disputes the allegation, classifying it as defamation. The Israeli Ministry of Foreign Affairs accused South Africa of exploiting and devaluing the ICJ, in addition to stating that the African country supports the Hamas group, a central figure in the ongoing conflict, and denies that its Army is making disproportionate use of strength in its war against the Islamist Hamas movement in Gaza.
“Israel repudiates with disgust the defamation (…) of South Africa and its appeal to the International Court of Justice”.
The ministry's spokesperson, Lior Haiat, wrote on the social network X (formerly Twitter).
The conflict began on October 7, after Hamas' retaliation in Israel, which caused around 1.140 deaths, mainly civilians, according to Israel. Islamist fighters also captured around 250 people, half of whom are still held in the small Palestinian territory, according to Israeli authorities.
In response to the attack, Israel promised to “annihilate” Hamas and launched an intense air and ground offensive that left at least 21.507 people dead, most of them women and children, according to the latest report from the Ministry of Health of Hamas, which governs Gaza. since 2007.
Urgent Measures
The approximately 2,4 million inhabitants of the Gaza Strip, 85% of whom have been forced to leave their homes, face a disastrous humanitarian situation, as reported by the UN.
In its complaint to the ICJ, South Africa alleges that Israel, especially since 7 October 2023, is participating and is at risk of continuing to participate in acts of genocide against the Palestinian people in Gaza.
The ICJ is responsible for adjudicating disputes between States, and its decisions are final, but it does not have the means to guarantee their immediate execution. It can, however, order urgent measures pending the complete resolution of cases, a process that can sometimes take years.
Last month, the International Criminal Court (ICC), also based in The Hague, received a request for an investigation into the situation in the " State of Palestine " from South Africa, Bangladesh, Bolivia, Comoros, and Djibouti.
In 2021, the ICC had already begun an investigation into alleged war crimes in the Palestinian Territories, involving Israeli forces, Hamas and other Palestinian armed groups.
South African President Cyril Ramaphosa compared Israeli actions towards Palestinians to segregation during apartheid in South Africa, highlighting the seriousness of the conflict. The human rights watchdog suggests that the ICJ could review Israel's actions in light of the 1948 genocide convention.
South Africa specified in its request that it seeks the ICJ to establish Israel's responsibility for violations of the genocide convention and to take urgent measures to protect the Palestinian people in Gaza, including an immediate end to all military attacks. form
Conclusion
This conflict has been extreme on both sides, in which on the one hand Hamas is accused of being a terrorist group, but on the other, Israel behaves worse than terrorists, even worse than Nazis but is legitimized with the bullshit of “They have right to defend oneself.” However, the designation of a terrorist organization is a complex issue and often depends on the perspective of the country or entity making it.
In the case of the Israeli-Palestinian conflict, organizations such as Hamas are labeled as terrorists by some countries, including the United States and Israel, while others, such as Qatar, South Africa and Turkey, may have a different approach, often considering them as legitimate resistance groups.
It depends on each one of us, through analysis of the conflict, to decide who is or is not the real terrorist and after that decision is made, to be at peace with our soul, if we are capable of doing so.
