South Africa has formally accused Israel of genocide in the Palestinian enclave of Gaza, filing a lawsuit with the International Court of Justice (ICJ), the principal judicial organ of the UN , in The Hague.
With this action, South Africa seeks to obtain a provisional order for the immediate suspension of Israeli military operations. The process itself can take years, but an interim order can be issued within weeks. For its part, Israel said it will contest the accusations, stating that South Africa is providing political cover for the Hamas attack that took place in October.
The Accusation of Genocide
Israel will face genocide charges brought by South Africa at the ICJ, according to an Israeli government spokesperson. Eylon Levy, from Prime Minister Benjamin Netanyahu's office, called the accusations an “absurd blood libel” and stated that Israel will appear at the ICJ to vigorously contest the accusation and added;
“We assure South Africa’s leaders that history will judge them and will judge them mercilessly.”
South Africa presented the case on Friday, December 29th , to the highest judicial body of the UN, accusing Israel of genocide against Palestinians in the Gaza Strip and asking the court to order Israel to end its attacks.
Israel, generally critical of international legal proceedings against it, considering them unfair and biased, is now responding seriously to the process, appearing before the ICJ, refuting the accusations of genocide, thus seeking to protect its international reputation. .
Genocide! Yes or no?
South Africa, following the attack by the Islamic Resistance Movement (Hamas) on October 7, filed a lawsuit with the ICJ, alleging genocide against Palestinians in Gaza seeking a provisional order to cease Israel's military operations, while the Middle Eastern country expresses a commitment to defending its actions in court.
Levy accused South Africa of providing political and legal support for the Hamas attack, which triggered the current war between Israel and the movement. The war, which began in October, has already killed 22 Palestinians, most of them women and children, but Israel blames Hamas for these losses, accusing it of using civilians as human shields to increase the number of casualties.
The current situation has lasted 88 days, threatening stability in the Middle East. The war between Israel and Hamas has led to a humanitarian crisis in Gaza, with 1,9 million people displaced (about 85% of the population), according to the UN, plunging the overpopulated and poor Palestinian enclave into a serious humanitarian crisis.
South Africa, with the case at the ICJ, seeks to hold Israel responsible for the acts it classifies as “genocidal”, but the outcome of the case could take years. Israel's response highlights the geopolitical complexity of the region and the international tension surrounding this conflict.
It is unknown what the concrete effects of an ICJ decision against Israel would be, but it is likely that it would isolate the country politically and economically.
Conclusion
The final outcome of this case remains uncertain, but an unfavorable decision at the ICJ could politically isolate Israel and have economic repercussions on the country. This episode highlights the complexity and tensions in the Israeli-Palestinian conflict, highlighting the need for a definitive diplomatic solution to guarantee stability in the region.
